The analysis of civil-law norms provided in the fourth part of civil procedure law of Russia allows to express opinion that apprehended and embodied by civil procedure law in sphere of regulation of the right to results of intellectual activity and individualization instruments in the criminal law is not reflected in full, in particular, in article 146 of the criminal code of Russian Federation.

USING EXPERTISE IN THE INVESTIGATION OF UNLAWFUL USE OF A TRADEMARK
Description
The author of the article explores the order of the using the special knowledge in the investigation of the unlawful use of the trademark, the forms of the using special knowledge. It is impossible to carry out the investigation of the illegal use of a trademark just as other economic crimes without the use of the special knowledge. The main task which is solved by means of the expert research is finding of the use on the certain products of the alien trademark, this means there are mismatches of the product quality with the quality of the claimed trademark. No matter in what forms the special knowledge is used (the expertise, the professional judgment or the debriefing of the knowledgeable person), it should be used at the time of the inspection reports of the illegal use of the trademark. The author has examined the procedures of the competent person, who invited as a specialist during the inspection of the seizure, counterfeit products; he showed the sequencing of the action for the implementation of the examination by a specialist. During the inspection the expert must assist the investigator (inquirer) in the identifying of those attributes that point to counterfeit products. The characteristic signs of the counterfeit products were investigated. It is highlighted the need for special knowledge in the field of merchandising, for the conducting of the merchandising researches in the investigation of the unlawful use of the trademark, is also needed for the appointment and other examinations such as patents; computer, technical and forensic examination of documents

Description
This article represents experience of a reflection over theoretical prerequisites of phenomenological and system approaches to a problem of forecasting of social reality. An object of research are the principle of multidimensionality of social reality in aspect of a determinism and indeterminism of social processes, and also the principle of causal asymmetry of time acting as the ontologic basis of multidimensionality of reality. It is claimed, that at the heart of statement of the major philosophical problems there is an experience of a touch to a phenomenon of multidimensionality of reality. Multidimensionality of reality is shown as a dependence of fundamental characteristics on the level of theoretical generalization and an intentionality of the consciousness registering reality in its existence. The hypothesis of multidimensionality of social reality assumes that social processes can be described and as strictly determined, predicted and as depending on a free will of the person depending on the level of theoretical generalization at which they are considered. The principle of causal asymmetry of time is a form of multidimensionality of time and a condition of multidimensionality of process, including social. At the heart of causal asymmetry of time, there is a systemacity of time, not reducibility of time neither to consciousness, nor to life. It is shown that is impossible differently as through the synthesizing activity of consciousness, to connect together two senses, equally directly related at the right time: duration keeping time in some equal unity of the moments and the variability, change of times expressing ontologic exclusiveness of the present moment. Multidimensionality and asymmetry of time can be considered as theoretical prerequisites of phenomenological and system approach to a problem of social forecasting

YOUTH LANGUAGE MENTALITY AS A WAY OF EXPLORING THE WORLD

In this article, we are talking about language mentality of youth. The problem is multifaceted and allows the researcher to see different aspects of the interaction of language and mentality, and also their actions in unity. Mentality of young people is largely determined by social conditions, which is expressed in language features. Language, in turn, has some formative influence on the socialization process of the youth mentality.
